By using the DataPass website and registry, you agree to these terms. Please read them carefully.

1. Acceptance of Terms

By accessing or using DataPass (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

DataPass provides:

  • The LLM Data Card specification and documentation
  • Tools for creating and validating data cards
  • A registry of published data cards
  • Community resources for data documentation

3. Use of the Service

3.1 General Use

You may use the Service for lawful purposes in accordance with these Terms. The documentation, schema, and tools are provided for the purpose of documenting datasets.

3.2 Prohibited Uses

You agree not to:

  • Use the Service for any unlawful purpose
  • Submit false or misleading information in data cards
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service
  • Use the Service to distribute malware or harmful content
  • Scrape or harvest data from the Service for commercial purposes

4. Registry Submissions

4.1 Submission Requirements

When submitting data cards to the registry, you represent and warrant that:

  • The data card accurately describes the dataset
  • You have the right to publish the information contained in the data card
  • The submission does not violate any applicable laws or regulations
  • The submission does not infringe on any third-party rights

4.2 Data Card Accuracy

Data cards must accurately represent:

  • Licensing terms and restrictions
  • Personal data content and consent mechanisms
  • Data provenance and sources
  • Access availability and requirements

Intentionally false or misleading data cards may be removed from the registry.

4.3 License Grant

By submitting a data card to the registry, you grant DataPass a non-exclusive, worldwide, royalty-free license to:

  • Display the data card in the registry
  • Include the data card in registry exports and APIs
  • Use the data card for research and analysis of the registry

4.4 Removal

DataPass reserves the right to remove any data card from the registry for any reason, including but not limited to:

  • Violation of these Terms
  • Inaccurate or misleading information
  • Legal compliance requirements
  • Request from the original submitter

5. Intellectual Property

5.1 Schema License

The LLM Data Card schema is released under the Apache License 2.0. You may freely use, modify, and distribute the schema in accordance with that license.

5.2 Documentation License

The DataPass documentation is released under the Creative Commons Attribution 4.0 International License (CC BY 4.0). You may share and adapt the documentation with appropriate attribution.

5.3 Third-Party Content

Data cards in the registry describe third-party datasets. DataPass does not own or control these datasets. The rights to datasets remain with their respective owners as indicated in each data card.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

DataPass does not warrant that:

  • The Service will be uninterrupted or error-free
  • Data cards in the registry are accurate or complete
  • Datasets described in data cards are available or accessible
  • The Service will meet your specific requirements

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATAPASS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

8. Indemnification

You agree to indemnify and hold harmless DataPass and its affiliates from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

9. Changes to Terms

We may modify these Terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
